The Adams County Record Wednesday, November 2, 2016 Page 11 Text of Proposed Amendment IN THE HOUSE OF REPRESENTATIVES HOUSE JOINT RESOLUTION NO. 5 BY STATE AFFAIRS COMMITTEE A JOINT RESOLUTION PROPOSING AN AMENDMENT TO ARTICLE BL OF THE CONSTITUTION OF THE STATE OF IDAHO, BY THE ADDITION OF A NEW SECTION 29, ARTICLE BL OF THE CONSTITUTION OF THE STATE OF IDAHO, RELATING TO THE LEGISLATIVE RESPONSE TO ADMINISTRATWE RULF~ STKTING THE QUESTION TO BE SUBMITTED TO THE ELECTORATE; DIRECTING THE LEGISLATIVE COUNCIL TO PREPARE THE STATEMENTS REQ~ BY LAW; AND DIRECTING THE SECRETARY OF STATE TO PUBLISH THE AMENDMENT AND ARGUMENTS AS REQUIRED BY LAW. Be It Resulved by the Legishtu~ of the St3te of Ida.: SECTION 1. "Ihat Artide I~ of the Constitution of the State of Idaho, be, and the same is hereby amended by the addition thereto of a NEW SECTION, to be known and designated as Section 29, Article IIL of the ConsOmion of the State of Idaho and to read as follows: SECTION 29. LEGISLATIVE RESPONSE TO ADMINISTRATIVE RUI23. The legishmre may review any administrative rule to ensu~ it is cons~at with the legishtive intent of the statute that the rule was written to intmpr~ ~ ~1~ or en~rc~ Aeer that review, the legislature may approve or r~ec~ in whole or in par~ any rule as provided by law. By stamt~ agencies make rules dmt only iraerpret and implement these laws, and the legislature reserves the authority to review and reject agency rules if a rule is oontrary to the ir~mt of the law. q[he LegblalaJre's ability to approve or r~ect agency rules is an importaut aspect of the separation of powers, because these rules have the force and effect of law. The Legislature currendy oversees tJaat rulemaking precess by accepting or rejecting agency rules. ~he proposed amendment confirms and protects the Legishture~ practice to authorize agency rulenml4n& and to accept or ect agency rules. "[he proposed conaimtional amendment would promct the legislature's authority to ensure that agency rules confoma with legislative intent. 32f a future court determined the legislatore did not have the right to review and reject agency rules, then ldahoans would have to hire lawyers and file lawsuits to ~ agencies' rides. That would be a much more expansive and tirne-consuming process than the current system which this amendment proposes to protect 4.A Governors veto is not t~quir!xL beceuse agency rules are proposed by the Governor's departmenls and agendes.
